Thomas Smidt III, who answers to Tom, Tommy, Tom 3 and “Tom the Younger” (to distinguish him from his father and law partner, Thomas Smidt II, who also goes by Tom Smidt), practices primarily in estate planning, trust and estate administration, and litigation involving estates and trusts. He has litigated cases involving both small estates and multi-million dollar estates on claims ranging from incompetence and undue influence to apportionment of estate taxes and failure to properly administer creditors’ claims against an estate. He also litigates commercial disputes involving contracts and real estate. He has prepared Wills, Trust, Powers of Attorney (financial and health care), and Advance Health Care Directives for countless clients. In addition, he has assisted clients navigate the probate process both in district courts and probate courts and handled ancillary probate proceedings for out-of-state probates. Tom also advises clients on the formation and administration of corporations, limited liability companies, and other business entities.

Tom has served on the Board of Directors of Roadrunner Food Bank and the All Faiths Receiving Home Foundation. He also served as President of the Albuquerque Academy Alumni Council. He currently serves on the Board of Trustees of the Albuquerque Academy, a private college preparatory school.
Following law school, Tom clerked for a year for the Honorable Judge John A. Terry of the District of Columbia Court of Appeals, in Washington, D.C., preparing case briefs and draft decisions for Judge Terry.
